Defending motor accident compensation claims
It can be frustrating to discover your car insurance company has decided to pay up even though you were not liable. This is because it is sometimes the cheaper option for the insurance company rather than going to court and paying costs and risking a higher payout.
It may surprise you to know that if someone puts in a claim of say up to five hundred pounds against you the insurance company may pay up without even telling you. They seem to assume you were guilty the first you may know is when you renew your premium.
If you know it is possible to object and insist the matter goes to court and you may find the matter goes no further.
I have known a white van man with damage to rear end blame other drivers in a public car park and to threaten to claim against them.
In this case you should always involve the police even though no one has been hurt and check out any cameras that may prove your innocence .take photos the mobile phone is good for this and do not admit liability.
It is often this person will be quite forceful and threatening but stand your ground.
If need be take the registration and contact the policeman. a solicitor can defend you and trace the other driver any witnesses must if possible give their names and address and may be asked to go to court in your defence. Also ask any shops if you can have a copy of any security film that may prove your innocence they may be reluctant to give it to you but the police or your solicitor should be able to get a copy.
If you have been involved in an accident that was not your fault you may be able to claim compensation. If the other driver drove off or you were not wearing a seat belt you may still be eligible. Any damages may possibly be reduced by approximately twenty five percent if they were caused by your lack of wearing a seat belt. If you have no details of the other driver or they had no insurance or drove off then the Motor Insurers Bureau may be able to compensate you in these circumstances.
There are lots of solicitors out there that deal with defending you if you are involved in a road traffic accident.
