How long do compensation claims take?

It depends in the type of claim you are trying to make.

If you are claiming compensation against most credit union claims can be completed within four weeks. For other types of claim it may take longer, depending on how complex it is and on some factors that may be outside of our control, such as waiting for information from third parties

If all the relevant paperwork is in order and the other side has admitted liability. In order to reduce long legal battle, expenses, time and effort, they know they're in the wrong, so it's best for them to settle early.

Since 1999, insurance companies have been ordered to co-operate with personal injury claimants under a set of court rules called the ‘Protocol’.

Insurance companies have five weeks to acknowledge receipt of a claim

They then have another three months to consider whether they accept the claim or not.

If they accept the claim they have another three weeks after they have seen the medical evidence to make an offer of compensation

If the insurance company does not admit fault or does not make an offer that is acceptable to the claimant, then the case goes to court for trial.

There is a strict timetable in place to determine when a case goes to court for trial.

A disputed case will take about eight months before coming to trial.

In cases where fault has been admitted it will usually take approximately three months to settle from the date liability has been admitted.

If liability is not admitted it can take a lot longer. each case is different.you may have had ijuries that take time to assess the severity some whip lash injuries are pain free after 3 month some people are still in agony after 6 months so time is needed to get medicals and to see how damaged you are or how well mature will repair the damage.

You don’t want to settle for a quick whip lash injury and later discover your injuries are far worse and if you had waited you would have been entitled to more compensation.

Sometimes it can be hard to decide who is liable or there may be several people all denighing liability and your legal team have to decide who to go after compensation with the best chance of getting your compensation.
