Traffic compensation claims
You may have been a driver / passenger in a car / vehicle or on a motorbike or you may have been a cyclist or pedestrian.
Motorists are required by law to have a valid insurance policy which covers them for Personal Injury claims against them. This means that if you are injured by another motorist you will be able to make a claim for compensation and damages against their insurance company . however, if the other party does not have a valid insurance certificate you can still claim compensation through the motor insurance bureau
If you have been involved in a road traffic accident, you must report it to the police. You may be entitled to compensation whether you were a: Car driver Passenger Motor cyclist Pedal cyclist or a Pedestrian
If you are involved in a traffic accident you should Never admit that it was your fault Note the driver's name, address, vehicle registration number and insurance details Take names, telephone numbers and addresses of at least two witnesses.
Report the accident to the police as soon as possible If you are injured, see a doctor make sure he notes all your injuries as you will need medical evidence to prove you were injured Photograph visible injuries as it may help you to prove your injuries and the suffering you were caused as any bruising will heal.
Keep any damaged clothing and bike parts and try to get a written assessment of the damaged items, Keep a record and receipts of any expenses you have to make because of the accident.
If you are injured on a bicycle you may be able to get compensation if it was due to spillage or pot holes. You will need two independent witnesses and you must photograph the scene and any damage to yourself and your bike. Again if you are injured go and see a doctor and keep a note of any out of pocket expenses in relation to the accident.
Car accidents often happen because the driver is Driving too fast Not keeping a lookout Not braking fast enough or at all Not leaving enough stopping distance Ignoring traffic signals or road signs Not controlling a vehicle properly. talking on a mobile phone whilst driving. All of these could mean if you are in collision with the said vehicle that you could be able to claim compensation.
